HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.299 of 2016 ORDER:

This petition is filed to transfer F.C.O.P.No.227 of from the file of Additional Family Court, Visakhapatnam, to Senior Civil Judge, Peddapuram, or any other Court in Kakinada.

2. Wife filed this petition. According to her affidavit, her marriage with respondent was performed on 22.12.2012 at Visakhapatnam, in accordance with Hindu custom and rites, thereafter due to disputes, cases are filed against each other and some cases are pending at Peddapuram and the case filed by respondent is pending at Visakhapatnam. She stated that she has a life threat at Visakhapatnam and she expressed difficulty in attending the Court at Visakhapatnam. For these reasons, she prayed for transfer of O.P. from Visakhapatnam to Peddapuram.

3. Husband filed counter disputing the affidavit averments of petitioner and contended that wife influenced the police at Peddapuram in registering a criminal case and he apprehend that police may influence him to settle the matter and that he has also threat from the family of petitioner at Peddapuram and opposed for transfer of case either to Peddapuram or to Kakinada.

4. Heard both sides.

5. As the wife is expressing life threat at Visakhapatnam and husband is expressing life threat at Peddapuram and Kakinada, both advocates submitted that a middle place may be considered for transfer. As the Family Court, East Godavari is at Rajahmundry, I deem it appropriate to transfer F.C.O.P.No.227 of 2016 from Additional Family Court, Visakhapatnam to Family Court, East Godavari at Rajahmundry, for disposal in accordance with law, for which both sides agreed.

6. For these reasons, F.C.O.P.No.227 of 2016 is withdrawn from Additional Family Court, Visakhapatnam, and transferred to Family Court, East Godavari at Rajahmundry, for disposal in accordance with law.

7. Transfer C.M.P. is ordered accordingly.

8. Miscellaneous petitions pending, if any, shall stand closed.
