HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO WRIT PETITION No.12568 OF 2014 ORDER:
The petitioners seek writ of mandamus declaring the inaction of the 2nd respondent herein in disposing of the appeal preferred by the petitioners on 24.07.2009 as illegal and consequently direct the 2nd respondent to disposal of the appeal.

On instructions from the 2nd respondent, learned Assistant Government Pleader would submit that no appeal has been received in the office of the 2nd respondent and documents produced by the petitioners in the Court do not contain any acknowledgment from the office of the 2nd respondent, from which it is clear that no appeal has been filed by the petitioner before the 2nd respondent. 3.
Learned Assistant Government Pleader thus submit that since no appeal is filed before the 2nd respondent, question of disposing of the said appeal does not arise.

There is no representation for petitioners today. 5.
Having regard to the submission of the learned Assistant Government Pleader, the writ petition is dismissed. Miscellaneous petitions pending, if any, shall stand closed. No costs.
