O R D E R
The case of the petitioner is that he purchased the subject open plot under registered agreement of sale-cum-GPA dated 13.04.2018 from its owner and has been in possession and enjoyment of the same and the municipal authorities have allotted number and that he also obtained electricity connection. While so, when the unofficial respondents trespassed into the subject plot and damaged the electricity meter, he lodged complaint with the 3rd respondent - Station House Officer, Rajendranagar Police Station, Cyberabad Commissionerate, Rajendrangar, but the said respondent instead of taking action, has locked the gate installed to the compound wall in the subject plot and kept the keys with him. Aggrieved by the same, the present writ petition is filed for a direction to the 3rd respondent to handover the keys to the petitioner.
Heard the learned counsel for the petitioner. Learned Assistant Government Pleader produced written instructions of Sub Inspector of Police, Police Station, Rajendranagar, Cyberabad, denying the allegations of the petitioner and stating that unofficial respondents filed complaint against the petitioner stating that they are the owners of the subject plot and are in possession of the same and that they constructed the boundary wall with a gate and that the petitioner trespassed into the same and, therefore, sought to take action. Based on the same, case in Cr.No.
1229 of 2018 was registered under Sections 447, 427 and 506 read with 34 IPC and investigation is taken up and that the keys of the locked gate of the subject plot, are with unofficial respondents 4 and 5, and that after completing investigation, appropriate report under Section 173 of Cr.P.C., will be filed before the court. Recording the above statement made in the written instructions, writ petition is disposed of, leaving it open to the petitioner to avail alternative remedies available under law.
