THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.31173 OF 2017 ORDER:
Heard.
2.
Petitioners are aggrieved by the order dated 30.06.2017 of the Tahsildar, Srikakulam District, holding that there is violation of provisions of the Andhra Pradesh Rights in Land and Pattadar Passbooks Act, 1971 (for short, 'the Act'). Consequential endorsement dated 07.09.2017 was issued to the petitioners informing them about the decision taken by the Tahsildar on 30.06.2017 and non-receipt of explanation by them. 3.
Aggrieved by the said order, remedy of appeal is available under the Act and without availing the said remedy, petitioners filed this Writ Petition.
4.
After arguing the case for some time, learned counsel for the petitioners seeks leave of the Court to file appeal before the appellate authority challenging the order of the original authority. He also seeks leave of the Court to file an application to stay the operation of the order dated 30.06.2017 passed by the Tahsildar. 5.
The Writ Petition is accordingly disposed of granting liberty to the petitioners to avail the remedy of appeal before the appellate authority. If the petitioners file application to stay operation of the order dated 30.06.2017 passed by the Tahsildar, the same shall be considered and appropriate decision be communicated to the petitioners within a period of three weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
