THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.9752 OF 2022 O R D E R:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure (for short "Cr.P.C") seeking regular bail to the petitioner who is arrayed as Accused No.4 in Crime No.826 of 2022 pending on the file of Station House Officer, Dundigal Police Station, Cyberabad registered for the offences punishable under Section 20(b)(ii)(B), 8(c) read with Section 22 (A) of NDPS Act, 1985.

Heard learned counsel for the petitioner-Accused No.4 and learned Additional Public Prosecutor for the respondent-State. Perused the record.

The Dundigal Police found this petitioner in possession of 10.4 kgs of ganja and also 0.5 grams of MDMA drug. The petitioner was remanded to judicial custody and the crime is being investigated.

On instructions learned Additional Public Prosecutor would submit that there are no other cases pending against this petitioner.

In the said circumstances, keeping in view the age of the petitioner and also that the seized contraband is intermediary quantity, the petitioner can be granted the relief of regular bail. 6.

Accordingly, the Criminal Petition is allowed and the petitioner-Accused No.4 is granted bail subject to the following conditions:

i) The petitioner-Accused No.4 is directed to be released on bail on his executing personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for a like sum each, to the satisfaction of VIII Additional Chief Metropolitan Magistrate at Medchal.

ii) After release on bail, the petitioner-Accused No.4 shall appear before the concerned Station House Officer on every Monday and Thursday between 10.30 AM and 01.00 PM for a period of six (06) weeks and thereafter as and when required for the purpose of investigation.

iii) The petitioner-Accused No.4 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.
