Heard Sri P.V.V. Satyanayayana, learned counsel for the petitioner, Sri M.S.R. Chandra Murthy, learned Standing Counsel for 3rd respondent and Sri Ravi Cheemalapati, learned Standing Counsel for 4th respondent.

The case of the petitioner is that he was appointed as Field Assistant under National Rural Employment Guarantee Scheme on 30.03.2006 at Nagallavalasa Village. Nagallavasala Village and Sadanandapuram Village are hamlets of Nagallavasala Gram Panchayat. As there was heavy work load in Nagallavasala Gram Panchayat, one Sri Reddy Srinu was appointed as Senior Mate to look after the work of Sadanandapuram from the month of February, 2014. It appears basing on the allegations made in the social audit report dated 13.03.2015, the 3rd respondent through order dated 28.04.2015 kept the petitioner under suspension and a show cause notice was also issued. The petitioner submitted his explanation dated 11.05.

2015 stating that due to pressure of work, at his request a Senor Mate was appointed for Sadanandapuram Village and the said Senior Mate was looking after the works and disbursements and the allegations made against him pertains to Sadanandqapuram Village in which he is not at all involved. According to the petitioner without considering the aforesaid explanation, he was unnecessarily kept under suspension and enquiry was also initiated against him. Hence he filed the present writ petition.

Since the enquiry is pending, I am not inclined to examine the merits of the matter at this stage. However, I deem it appropriate to direct the 3rd respondent to conduct enquiry taking into consideration the explanation submitted by the petitioner on 11.05.2015 and pass

appropriate orders in accordance with law within a period of eight weeks from the date of receipt of a copy of this order. With the above direction the writ petition is disposed of. No costs. Pending miscellaneous petitions, if any, shall also stand closed. __________________ R. KANTHA RAO, J.
