Heard learned counsel for petitioner and learned Government Pleader for Revenue.

Petitioner claims that he purchased an extent of Ac.3-00 guntas in Sy.No.12/C situated at Thimmayapally village, Keesara mandal, Medchal-Malkajgiri district vide registered sale deed dated 7.8.1985 from Bachala Veeranna, who inturn purchased the same from Pilli Setty Sakali Isthari by way of registered sale deed dated 5.7.1967. After purchase, the name of petitioner was mutated in the revenue records and pattadar passbooks and title deed were also issued in his favour. When the petitioner intends to sell the subject property, he came to know that his land is entered in the list of prohibited list of properties maintained by the Government under Section 22-A of Registration Act, 1908. Being aggrieved by the same, the present writ petition is filed.

The issue of inclusion of properties in the prohibited list under Section 22-A of the Registration Act, 1908 (for short, 'the Act') was considered by the Full Bench of this Court in VINJAMURI RAJAGOPALA CHARY v. STATE OF ANDHRA PRADESH1 giving several directions. Therefore, an aggrieved person has to avail remedy as indicated by the Full Bench with reference to the grievance of petitioner against inclusion of his property in the prohibited list. In fact, petitioner also made representation to the 2nd respondent-District Collector, which was acknowledged by the office of District Collector on 1 2015 (3) ALT 96

9.1.2018, requesting to delete his patta land from the list of prohibited properties.

In view thereof and in view of the judgment of the Full Bench referred above, the writ petition is disposed of directing the 2nd respondent-District Collector to consider the request of the petitioner for deletion of his property from the list of prohibited properties under Section 22-A of Registration Act by placing before the Committee and pass appropriate orders, as per law, within a period of eight (8) weeks from the date of receipt of a copy of this order. Pending miscellaneous petitions, if any, shall stand closed.
