THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.9680 of 2022 ORDER:

This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, seeking pre-arrest bail to the petitioner/Accused in the event of his arrest in C.O.R No.61 of 2020 on the file Excise Police Station, Zaheerabad, Sanga Reddy District registered for the offence punishable under Section 8 (b) read with Section 20 (a) of the Narcotic Drugs and Psychotropic Substance Act, 1985.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State. Perused the record.

The Excise Police, Zaheerabad registered a case on 11.05.2020 having found 46 Ganja plants in the land which belongs to this petitioner. The counsel for the petitioner submits that he is aged about 60 years and he has nothing to do with the said Ganja plants found in his land.

However, keeping in view his age and crime being registered in year 2020, this Court deems it appropriate to direct the petitioner to surrender before the police concerned and upon such surrender, he shall be released on bail on executing personal bond for a sum of Rs.20,000/- (Rupees Twenty Thousand Only) with two sureties for a like sum each. Further, the petitioner shall continue to appear on every day for two weeks and thereafter, as and when required. 5.
