HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Civil Revision Petition No. 1611 of 2015 Order:

This Civil Revision Petition is filed challenging the order in EP No.56 of 2011 in OS No.13 of 1985, dated 27.01.2015, passed by the learned Senior Civil Judge, Penukonda, allowing the EP in a suit for specific performance of agreement of sale, dated 10.12.1982.

2. Against the decree in OS No.13 of 1985 the petitioner herein and JDr No.4 filed AS No.2050 of 1990 before this Court and the said appeal was dismissed on 23.09.2008. In the present CRP, learned counsel for the petitioner/JDr No.3 raises the same grounds that were raised in AS No.2050 of 1990 and, in view of dismissal of the said appeal, the said grounds cannot be entertained.

3. Accordingly, the Civil Revision Petition is dismissed. However, in the circumstances, no costs.

4. As a sequel thereto, the miscellaneous petitions, if any, pending in this Civil Revision Petition, shall stand closed. ________________________ A.
