THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.44334 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking to declare the action of the respondents 2 and 3 in not registering the case upon the complaint of the petitioner, dated 01.12.2015, and the subsequent reminder representations, dated 13.06.2016 and 20.09.2016, as illegal and arbitrary and consequently, direct the respondents to issue FIR and cause proper investigation into the matter.

Heard and perused the material available on record. The main grievance of the petitioner is that the Station House Officer, Athreyapuram Police Station, East Godavari District - 3rd respondent is not registering a case basing on the complaint, dated 01.12.2015 and also the subsequent representations, dated 13.06.2016 and 20.09.2016, made by the petitioner.

Considering the grievance of the petitioner the 3rd respondent is directed to register a case basing on the complaint, dated 01.12.2015 and also the subsequent representations, dated 13.06.2016 and 20.09.2016, made by the petitioner, if there is any cognizable offence, and investigate into the same and file a final report if any. If the petitioner is aggrieved over the action of the 3rd respondent, he is at liberty to approach the superior officer of the 3rd respondent and also to approach the concerned Court by invoking provision under Section 200 Cr.P.C.

Accordingly, the writ petition is disposed of. No order as to costs. Pending Miscellaneous Petitions, if any, shall stand closed. ______________ RAJA ELANGO, J December 20, 2016.
