This Civil Revision Petition is filed against the order dated 05-12-2016 passed in I.A.No.498 of 2016 in O.S.No.149 of 2009, wherein the Court below dismissed the application filed by the petitioner for amendment of suit schedule property Learned counsel for the petitioner submits that survey numbers are wrongly mentioned in the suit schedule property. As such, the application in the above IA was filed and the Court below erroneously dismissed the same. The Court below dismissed the application mainly on the ground that no plausible reason is given seeking amendment of schedule property that too after the suit is posted for judgment. The Court below also found that at the belated stage, the said application is filed. A reading of affidavit filed in support of the application is also vague.

The suit is of the year 2009, entire evidence has been recorded and after the matter is heard and posted for judgment, at that stage the application for amending the suit schedule has been filed. Accordingly, the Court below has correctly analyzed the factual situation and by relying on several judgments dismissed the application.

In view of the same, this Court finds no reason to interfere with the impugned order by exercising judicial review under Article 227 of Constitution of India. Accordingly, the Civil Revision Petition is dismissed.
