HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:

Petitioner claims to be the owner of agricultural land to an extent of Ac.0.43 cents in Sy.No.184-3 of Bramanayaluru village, Atmakuru Mandal, Ananthapuram district. According to the petitioner, Bore-well was dug in his property and also obtained electric connection to the said bore-well way back in the year 1995. While so, Y.Eswar Reddy (3rd respondent), who owns land in Sy.No.184 of the same village, illegally dug the bore-well within 50 feet distance from the existing bore-well even without obtaining prior permission. It is the case of petitioner that on account of digging of such bore-well within short distance and extracting of water, it would cause grave hardship to the petitioner. Therefore, petitioner filed complaint against digging of such bore-well by the 3rd respondent violating the A.P.WALTA Act.

Though the said complaint was filed long ago, no action is taken so far. According to the learned counsel for petitioner, on 19.07.2017, notice was issued to the 3rd respondent to appear before the Tahsildar by fixing date on 25.07.2017. Thereafter, there is no further progress. 2.

On instructions, learned Government Pleader submits that matter is pending consideration of the Tahsildar and if reasonable time is granted, appropriate orders would be passed. 3.

Having regard to the said submissions, without entering into merits of the case, writ petition is disposed of directing the Tahsildar, Atmakur Mandal (2nd respondent) to finalize the issue regarding complaint of the petitioner in pursuant to the notice

given in R.C.No.(B)/220/2017 dated 19.07.2017, as expeditiously as possible, preferably within a period of six weeks from the date of receipt of a copy of this order after, affording due opportunity to both parties and on due consideration of the respective submissions.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
