THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.29255 OF 2013 ORDER:

This Writ Petition under Article 226 of the Constitution of India came to be filed by the petitioner seeking to declare the action of the second respondent in issuing show cause notice No.E1/701/HR/2013 dated 03.08.2013 as illegal and arbitrary and consequently to direct the respondents to reinstate the petitioner into the post of Field Assistant, Lalthanda-2 Gram Panchayat, Mothey Mandal, Nalgonda District.

On 19.04.2017, as there was no representation on behalf of the petitioner, the matter was directed to be listed on 25.04.2017 under the caption 'for dismissal'. In spite of the matter being listed under the said caption, there is no representation for the petitioner even today also.

Learned counsel for the respondents would submit that instead of submitting explanation to the impugned show cause notice, petitioner approached this Court.

Even otherwise, as seen from the record, the impugned proceedings came to be issued in the year 2013 and no interim order was passed by this Court. The enquiry must have been completed by now.

Having regard to the factual situation, the Writ Petition is disposed of directing the petitioner to submit his explanation, if no enquiry is commenced till date, pursuant to the show cause notice dated 03.08.2013. However, if any order is passed pursuant to the

impugned show cause notice, the petitioner can avail the remedies available under law.

Miscellaneous Petitions pending in this petition, if any, shall stand closed. No order as to costs.
