Naini Jayamala Reddy v. The State Of Telangana

THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.28896 of 2018 Heard learned counsel for the petitioner and Smt.Pingali Lakshmi, learned Standing Counsel for the Greater Waragal Municipal Corporation.

When the matter is taken up, it is submitted by the learned counsel for the petitioner so also the learned Standing Counsel that the issue, in the present Writ Petition, is squarely covered by the order of this Court in W.P.No.37487 of 2014 dated 05.12.2014. A copy of the said order is placed on record.

Following the above said order and, for the reasons recorded therein, this Writ Petition is also disposed of, in terms thereof, with the following order:

"Within four (04) weeks from the date on which the petitioner re-submits his application for building permission, respondent Nos.2 and 3 shall consider the same in accordance with law, including the provisions of the Greater Hyderabad Municipal Corporation Act, 1955 and the Rules and Bye-laws made therein, take a decision thereupon and communicate it to petitioner". Office to enclose a copy of the order, dated 05.12.2014, passed in W.P.No.37487 of 2014 to this order.

Miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
