HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.28883 OF 2018 ORDER:

The present writ petition came to be filed seeking to declare the action of the 3rd respondent in not hearing and disposing of the appeal filed by the petitioner in Roc.No.B4/1811/2017 under Section 5(5) of Records of Rights in Land and Pattadar Passbooks Act, 1971 (for short, "the Act"), seeking to cancel the pattadar passbook and title deed issued in favour of the 5th respondent and delete the entries made in all the revenue records, as illegal and arbitrary.

When the matter is taken up for hearing, learned Government Pleader for Revenue, placed on record the judgment of the Division Bench of this Court reported in Ratnamma vs. Revenue Divisional Officer, Ananthapur District and others1, to show that no appeal would lie before the 3rd respondent-Sub Collector which is not seriously disputed by the learned counsel for the petitioner. Having regard to the above stated circumstances, I see no reasons to give any directions to the respondent-authorities before whom the appeal is pending for its disposal. However, the petitioner is always at liberty to take steps in accordance with law and get the defects rectified. With the above direction, the writ petition is disposed of. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
