ORAL ORDER:

Petitioner alleges that his ancestors donated piece of land for burial ground to Wakf Board but the Wakf Board is not maintaining the said land and there are illegal encroachments and constructions are made by third parties who are no-way concerned with the Wakf Board. Petitioner submitted a representation on 18.8.2016 to the Wakf Board followed by another representation on 19.8.2016. Contending that no orders are passed on the said representations, this writ petition is filed. Learned standing counsel for respondent Wakf Board disputes the fact that representation filed by the petitioner is pending and so far no orders are passed. He also expressed doubt about the claim of the petitioner that his ancestors donated the land to the Wakf Board.

Since a complaint is filed before the Wakf Board, it is open for the respondent Wakf Board to call for information required to ascertain genuineness of the claim of the petitioner and after ascertaining the same, shall consider the representation submitted by the petitioner on the allegation of illegal constructions being made by unconcerned persons on wakf property. Decision to this effect should be taken as expeditiously as possible, preferably within a period of six weeks from the date of receipt of copy of this order. Accordingly, the writ petition is disposed of. No costs. Having regard to the same, miscellaneous petitions, if any pending, are closed. ______________ P NAVEEN RAO,J DATE: 29.11.
