THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.4748 of 2015 ORDER:

The criminal petition is filed under Section 482 Cr.P.C. to quash the proceedings in C.C.No.122 of 2014 on the file of the XIII Additional Chief Metropolitan Magistrate, Hyderabad.

Heard the learned counsel appearing for the petitioners and the learned Additional Public Prosecutor, representing the State. Basing on the complaint lodged by the 2nd respondent/complainant the police registered a case against the petitioners herein for the offences punishable under Section 498-A IPC and Sections 3 and 4 of the Dowry Prohibition Act. The allegations in the complaint, prima facie, reveal the commission of offences punishable under Section 498-A IPC and Sections 3 and 4 of the Dowry Prohibition Act by the petitioners herein and the trial is warranted. Hence, there are no valid grounds to quash the proceedings in C.C.No.122 of 2014. In the facts and circumstances of the case and as requested by the learned counsel for the petitioners, the Criminal Petition is disposed of, directing the learned Magistrate to proceed with the trial in C.C.No.122 of 2014. However, the appearance of A2 to A4 should not be insisted unless it is necessary. Pending miscellaneous applications, if any, shall stand closed in consequence.
