THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.7635 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

"to issue writ of mandamus or any other appropriate; (i) declaring that the proceedings No.E1/785 (3)/2014RM (T) dated 07.08.2015 in so far as not sanctioning and releasing the pension on the last pay drawn by the petitioner of Rs.28.450/- as Driver and in not paying the interest on pension from July, 2009 onwards till the actual date of payment as illegal, arbitrary and unjust; (ii) consequently direct the respondents to fix the pension of the petitioner in the pay of Rs.28.450/- as driver and also direct the Respondents to pay the interest on arrears of pension payable from July, 2009 onwards till the actual date of payment and also interest on computation of pension."

Heard, Smt.K. Udaya Sri, learned counsel for the petitioner and Sri A. Rama Rao, learned Standing Counsel for respondents. When the matter is taken up, it is submitted by learned counsel for the petitioner that for redressal of the grievance of the petitioner, the petitioner herein submitted a representation on 2612-2015 to the Regional Manager, A.P.S.R.T.C., Tirupati Region, Chittor District - 2nd respondent herein and no orders have been passed on the said representation so far. A request is made by the learned counsel for the petitioner to direct the 2nd respondent to pass appropriate orders on the representation, dated 26-12-2015, in accordance with law, by fixing some timeframe. The said request is not opposed by the other side.

Recording the said submission and having regard to the nature of controversy, the writ petition is disposed of, without expressing any opinion on the merits of the matter and entitlement of the petitioner, directing the 2nd respondent to consider and pass appropriate orders on the representation, dated 26-12-2015 said to have been submitted by the petitioner herein, in accordance with law, within a period of one month from the date of receipt of a copy of this order.

Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
