Heard Senior Counsel Sri Ganta Rama Rao, learned counsel for the petitioner and learned Assistant Government Pleader for the respondents.

Petitioner claims he has purchased land to an extent of Ac.3.60 cents in Sy.No.7 of Koduru village, Garividi Mandal, Vizianagaram District. Petitioner is in possession and enjoyment of the subject property and mutation was done in his favour. 3.

According to learned Senior Counsel, lands to an extent of Ac.2.34 cents is in Sy.No.7/1 and Ac.1.26 cents is in Sy.No.7/2 and total extent of Ac.3.60 cents is owned by the petitioner. Now the Tahsildar re-classifies the survey numbers, treated the entire extent as Sy.No.7/1 and claims that land to an extent of Ac.2.34 cents out of Ac.3.60 cents belongs to Government. In view of the said report, petitioner apprehends dispossession without following the due process.

Learned Assistant Government Pleader, on instructions, submits that for the land claimed by the Government, due procedure will be followed before evicting the petitioner. 5.

In view of the said submissions, learned Senior Counsel submits that no further orders are required in this writ petition.

Accordingly, the Writ Petition is disposed of. It is needless to observe that the respondents shall follow due process as required by law, before evicting the petitioner from the land to an extent of Ac.2.34 cents. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
