HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND HON'BLE MS. JUSTICE J. UMA DEVI WRIT PETITION NO.27180 OF 2017 ORDER: (per Hon'ble the Acting Chief Justice Ramesh Ranganathan) The notice under Section 8(6), and the Sale notice under Rule 9(1), of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Rules are under challenge in this Writ Petition on the ground that the requirement of issuing the notice for a period in excess of thirty days has not been complied with. While the aforesaid two notices were issued on 28.07.2017, the auction is scheduled to be held on 18.08.2017, less than thirty days from the date of the earlier notices. It is, however, wholly unnecessary for us to examine this contention on its merits as Sri B.S.

Prasad, Learned Standing Counsel for the respondent bank, on instructions, states that the last date for receiving the bids expired today; the respondent bank has not received any bids so far; and a fresh notice would be issued by the respondent bank to put the subject property to sale. Sri S. Rahul Reddy, Learned Counsel for the petitioner, submits that other grounds, which the petitioner has raised in this Writ Petition, may be left open for adjudication on a challenge being made to any subsequent notices issued by the respondent bank.

Leaving it open to the petitioner to do so, the Writ Petition is dismissed as infructuous. The miscellaneous petitions pending, if any, shall stand closed. No costs.
