2. A.S.No.252 of 2014 is filed aggrieved by the judgment and decree, dated 21.02.2014, in Original Suit No.78 of 2011 passed by the III Additional District Judge, Gadwal.

3. Learned counsel, appearing for the appellants, states that during pendency of the appeal, appellant No.1 died on 22.10.2014 and appellant No.2 wants to withdraw the appeal.

4. Learned counsel appearing for the respondent states that he has no instructions from his client.

5. Recording the submission of the learned counsel for the appellants, the appeal is dismissed as abated against appellant No.1 and the appeal is dismissed as withdrawn against appellant No.2. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this appeal shall stand closed.
