THE HON'BLE SRI JUSTICE S.V. BHATT W.P.No.23771 of 2014 Oral Order:

The petitioner prays for mandamus declaring Proceedings dated 06/8/2014 as illegal, arbitrary and suffers from monotony and liable to be set aside. Briefly stated the case of the petitioner is that the petitioner was appointed as temporary Fair Price Shop dealer vide orders dated 26.2.2007. The operative portion of the orders appointing petitioner reads thus:

1. The permission is purely on temporary basis and liable to be terminated at any time before expiry of temporary period without giving any notice or assigning any reason.

She will acquire no right over the F.P. shop dealership in future by virtue of this temporary permission.

The Mandal Revenue Officer, Yerraguntla is directed to allot essential commodities to the above permitted dealer and see that essential commodities are distributed to all the cardholders properly." The grievance of the petitioner is that the second respondent without any reasons has passed the order impugned in the writ petition without complying with the requirement of taking steps for appointment of Fair Price Shop dealer on permanent basis.

At the time of hearing, the Assistant Government Pleader on instructions submits that the second respondent has taken steps for appointment of Fair Price

Shop Dealer for shop No.28 of Illuru Village,Yerraguntla Mandal, YSR Kadapa District on permanent basis and the temporary appointment can be worked out as long as there is no appointment on permanent basis.

By placing on record the statement of Assistant Government Pleader, the Writ Petition is dismissed. No costs. As a sequel, miscellaneous petitions if any, pending in this Writ Petition shall stand closed. JUSTICE S. V.
