The criminal petition is filed seeking for quash of the proceedings in PRC.No.104 of 2010 on the file of the II Additional Judicial Magistrate of First Class, Bhimavaram. 2.

Heard the learned counsel for the petitioner and the learned Public Prosecutor, who takes notice for respondent No.1. None appears for the second respondent in spite of notice. 3.

The case is filed for the offence under Section 506 of the Indian Penal Code against the petitioner. The allegations are that the petitioner threatened the complainant that if she filed a complaint, she will have to face dire consequences.

The counsel for the petitioner draws the attention of this Court to CRLPMP.No.9307 of 2017, which is filed by the defacto complainant seeking permission to withdraw the matter against the petitioner. The counsel also reports that the defacto complainant already got married and that the same can be understood from her description in the said petition, wherein she is described as W/ o. P. Suresh. 5.

In the aforesaid petition, the complainant states that she filed the complaint on the instigation of her Ex-husband, Yesudasu and that as she got married again, she is not interested in prosecuting the matter. Hence, no useful purpose would be served in continuing the proceedings in the above PRC against the petitioner.

The criminal petition is allowed and the further proceedings in PRC.No.104 of 2010 on the file of the II Additional Judicial Magistrate of First Class, Bhimavaram, against the petitioner, are hereby quashed. As a sequel, the miscellaneous applications, if any pending, shall stand closed.
