ORDER

This petition under Section 407 of Cr.P.C., is filed to withdraw C.C.No.9 of 2017 pending on the file of Metropolitan Sessions Judge-cum-Special Judge for AP Protection of Depositors of Financial Establishments Act, Visakhapatnam District, to any competent Court at Prakasam District.

Similar applications were filed before this Court for withdrawal and transfer of cases pertaining to M/s.Akshaya Gold Farms & Villa India Limited, Visakhapatnam, which are pending before the different District Courts and this Court, while exercising power under Section 407 of Cr.P.C., instead of transferring the matters to the Court of Principal District Judge-cum-Special Judge for A.P.Protection of Depositors of Financial Establishments Act, Ongole, ordered for withdrawal and transfer of cases to the Court of Principal District Judge-cum-Special Judge for A.P.Protection of Depositors of Financial Establishments Act at Guntur, Guntur District. Since the present petition is similar to those criminal petitions, I deem it appropriate to exercise power under Section 407 Cr.P.C.

In the result, the Transfer Criminal Petition is allowed and C.C. No.9 of 2017 pending on the file of the Metropolitan Sessions Judgecum-Special Judge for A.P.Protection of Depositors of Financial Establishments Act, Visakhapatnam District, is withdrawn and

MSM,J Tr.Crl.P.No.176 of 2018 transferred to the Court of Principal District Judge-cum-Special Judge for A.P. Protection of Depositors of Financial Establishments Act, at Guntur, Guntur District, to decide all the cases in accordance with law simultaneously. Miscellaneous petitions, if any pending in this petition shall stand closed.
