THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.38530 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking to direct respondents 2 & 3 to register case against the 4th respondent on the private complaint filed by the petitioner, dated 21.03.2016, which is referred by the VIII Metropolitan Magistrate, at Rajendranagar, Cyberabad.

Heard and perused the material available on record. The case of the petitioner is that the petitioner lodged a private complaint before the VIII Metorpolitan Magistrate, Rajendranagar, Cyberabad, against the 4th respondent alleging that the 4th respondent is evading the amount which is due to the petitioner. The grievance of the petitioner is that even though the VII Metropolitan Magistrate has referred the said complaint to the 3rd respondent, the 3rd respondent is not registering the same and that the 4th respondent is threatening the petitioner with dire consequences to withdraw the said complaint.

From the perusal of the record, it is evident that there is no order passed by the learned Magistrate to refer the complaint filed by the petitioner to the 3rd respondent, but at the same time, the copy of the complaint filed by the petitioner is placed before this Court.

Hence, the Writ Petition is disposed of with the following direction:

If there is any order passed by the learned VIII Metropolitan Magistrate, Rajendranagar Cyberabad, for referring the complaint filed by the petitioner to the 3rd respondent for registration of a

crime and investigation, the 3rd respondent is directed to register the same and shall dispose of the same in accordance with law. Accordingly, the Writ Petition is disposed of. No costs.
