ORAL ORDER:

In this writ petition, petitioner challenges the notice dated 1.12.2014 issued under Section 452(1) and 461 (1) of Hyderabad Municipal Corporation Act, 1955. The allegation made against petitioner was that he constructed compound wall without obtaining prior permission from the Commissioner. Case of the petitioner is that in response to the show cause notice, he submitted a representation/explanation dated 8.12.2014 explaining his stand on the allegation made and also requested for grant of permission for construction of compound wall.

As per the instructions of the learned standing counsel, no further orders are passed and the matter stands at the stage of issuance of show cause notice. Having regard to the said submission, writ petition is disposed of directing respondent municipal corporation to consider the representation/explanation submitted by the petitioner and to take appropriate decision as warranted by law as expeditiously as possible preferably within a period of three weeks and till such decision is taken, respondents shall not take any coercive action in the matter. No costs. Having regard to the same, miscellaneous petitions, if any pending, are closed.
