THE HONOURABLE Dr.JUSTICE B.SIVA SANKARA RAO Criminal Revision Case No.146 of 2017 ORDER:

Heard both sides and perused the material on record including the impugned order dated 25.11.2016 passed in Crl.M.P. No.844 of 2016 in S.C. No.679 of 2013 by the Special Judge for Economic Offences at Hyderabad, which is outcome of Crime No.750 of 2009 of P.S.Saifabad, registered for the offences punishable under Sections 489 A, B and C IPC and Section 227 Cr.P.C that was ended in dismissal holding that there is a prima facie accusation from the prosecution material.

A perusal of the order from the prosecution material show no way requires interference. Hence, the revision is dismissed before admission. In view of the difficulty expressed by the learned counsel for the petitioner that the petitioner is a resident of Chennai and it is practically difficult for him to attend for every adjournment, liberty is given to file application under Rule 37 of Criminal Rules of Practice, if other accused on record represents him for the learned Judge shall pass appropriate orders else the petitioner to invoke by filing an application under Section 317 Cr.P.C when there is a practical difficulty for personal appearance for respective particular adjournments by waiving personnel and physical presence and by stating the trial shall go on that respective dates in the presence of his advocate by giving consent for that.

Consequently, pending miscellaneous petitions, if any, shall stand closed.
