Heard counsel for the petitioner and Sri R.Vinod Reddy, Standing Counsel appearing for respondents.

Petitioner has assailed proceedings dt.06.07.2018 of the 2nd respondent provisionally assessing liability of Rs.20,538/- on the petitioner for alleged theft of electricity. 3.

It is stated by the counsel for petitioner that new meter has been installed and though power was initially disconnected on 25.05.2016, as of date there is power supply restored.

Therefore, subject to the petitioner paying 1/4th of the provisionally assessed amount, respondents are directed to refer the matter to the Special Court under Section 154(5) of the Electricity Act, 2003 for assessment of civil liability; and pending such assessment and subject to the petitioner making payment of 1/4th of the provisionally assessed amount, power supply to the petitioner's service connection shall not be disconnected.

The Writ Petition is disposed of accordingly. No order as to costs.

Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
