THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.33457 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking to declare the impugned memo No.4759/Endt.II/A1/2016-2 in Form No.1 vide RC No.A4/2412/2016, dated 29.08.2016, by 3rd respondent, calling/inviting applications from the interested persons for constitution of Non-hereditary Trust board to the 5th respondent subject temple i.e., Sri Ramachandraji Temple, Sathamrai Village, Shamshabad Mandal, Ranga Reddy District, as illegal and arbitrary.

Heard and perused the material available on record. The case of the petitioner is that petitioner is the founder family member of Sri Ramchandraji Temple, Satamrai, Shamshabad Mandal, Ranga Reddy District and the said temple is registered with the Endowments Department and the petitioner got declared as member of founder family.

The grievance of the petitioner is that the 3rd respondent has issued the impugned memo, dated 29.08.2016, informing that a trust board will be constituted to the 5th respondent temple and interest persons may send their applications for trusteeship. Learned counsel for the petitioner submitted that the impugned memo was issued on 29.08.2016, but the 3rd respondent signed on the impugned memo on 08.09.2016, which clearly indicates that the said notice was issued with ante date and that no time limit was specified in the notification calling for the applications for trusteeship. Learned counsel for petitioner also

fairly submitted that even though the impugned memo is ante dated, the petitioner could not be able to substantiate any prejudice caused to him.

Having regard to the facts and circumstances of the case and the submissions of the learned counsel for the petitioner, this Court is of the view that there is nothing to interfere with the impugned notification issued by the 3rd respondent, which is in accordance with law.

Accordingly, the Writ Petition is dismissed. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ____________________ RAJA ELANGO,J Date: 20th October, 2016 KL
