Samkrg Pistons And Rings Limited, v. Chairman Industrial Tribunal And Presiding Officer,
THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.22606 of 2016 ORDER:
Petitioners have filed this Writ Petition challenging the order dt.01-07-2016 passed by the 1st respondent-Tribunal in I.A.No.11 of 2015 in I.D.No.48 of 2015.
2.
Sri V.Sudhakar Reddy, learned counsel for respondent Nos.2 and 3 has brought to my notice that a memo has been filed by 2nd respondent before the 1st respondent seeking to withdraw the Industrial Dispute on the ground that there is an amicable settlement between the petitioners and respondent Nos.2 and 3. 3.
Counsel for both sides state that in view of the pendency of the present Writ Petition, the Tribunal has not passed any orders on the memo filed by 2nd respondent seeking withdrawal of the Industrial Dispute in view of the settlement between the parties. 4.
In view of the said memo placed on record by learned counsel for 2nd respondent, the Writ Petition has actually become infructuous. 5.
Accordingly, the Writ Petition is dismissed as infructuous. No costs.
6.
However, in the event, if the 1st respondent does not permit withdrawal of the Industrial Dispute pending before it, the petitioners are granted liberty to revive this Writ Petition.
MSR,J W.P.No.22606 of 2016 7.
As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
