This writ petition is filed aggrieved by the action of respondents 2 to 5 in not taking action to stop respondents 6 to 8 from leaving the country and procuring their presence in Cr.No.48 of 2018.

Learned Assistant Government Pleader for Home produced written instructions stating that basing on the complaint of the petitioner, a case in Cr.No.48 of 2018 was registered for the offences punishable under Sections 498-A, 406 IPC and Sections 3 and 4 of Dowry Prohibition Act against husband of the petitioner and took up investigation. During the course of investigation, the complainant and other witnesses were examined and recorded their statements in part-II. As per the directions of Supreme Court in Arnesh Kumar v State of Bihar1 and Rajesh Sharma v. State of U.P.,( Crl.A.No.1265 of 2017, dated 27-07-2017 (SLP (Crl.No.2013 of 2017), the matter was referred to Family Welfare Committee. During further course, a notice under Section 41-A Cr.P.C.

was served on A-1, A-2, A-3 and A-5 in the above crime and accused attended before the Station House Officer and learnt that A-1 is presently residing in Australia. On 25-07-2018, a report from the Family Welfare Committee has been collected. It is also stated that A-1, A-2, A-3 and A-5 attended before the Station House Officer on receipt of notice under Section 41-A Cr.P.C.

and submitted reply and assured that as and when required, they will appear before him.

Recording the same, the writ petition is disposed of. . As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
