HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9003 of 2016 O R D E R:

This petition is filed by the petitioner-accused under Sections 437 and 439 of the Criminal Procedure Code seeking to grant bail to him in Crime No.54 of 2016 on the file of Excise, Vikarabad, registered for the offence punishable under Sections 8(c ) r/w 22 of NDPS Act, 1985 and Rule 27(i)of A,.P. Excise Rules, 2007. It is alleged that the petitioner was found in possession of 1 Kg. Alpazolam and contraband.

Learned Counsel for the petitioner submitted that the petitioner did not commit any offence and he was falsely implicated in the above crime and that the petitioner was arrested on 1.6.2016 and since then, he has been in prison.

Learned Additional Public Prosecutor opposed this petition and submitted that the investigating agency has yet to collect information as to the sources from which the petitioner procured Alpazolam. Considering the facts and circumstances of the case and the nature of the offence, this Court is not inclined to grant bail to the petitioner at this stage.
