THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.6123 of 2015 ORDER:
The criminal petition is filed under Section 482 Cr.P.C. to quash the proceedings in C.C.No.559 of 2014 on the file of the Judicial First Class Magistrate, Wanaparthi, Mahaboobnagar District. Heard the learned counsel appearing for the petitioners/A4 & A5 and the learned Additional Public Prosecutor, representing the State. It appears from the complaint that the 2nd respondent/wife made specific complaint under Section 498A of IPC and under sections 4 & 6
of Dowry Prohibition Act against the petitioners/A4 & A5 and others. It further appears that on the basis of the said complaint a specific police case was initiated which culminated into filing of a charge sheet. The truth or otherwise of the allegations can only be decided during course of trial. This Court is not supposed to make a roving enquiry into the allegations made in the charge sheet. I absolutely see no valid ground to quash the charge sheet.
Learned counsel for the petitioners/A4 & A5 submits that the 1st petitioner/A4 is the sister of non-petitioner/A1 and the 2nd petitioner/A5 is stranger and he is an RMP Doctor and it will be difficult for the petitioners/A4 & A5 to attend for each and every adjournment in the above case and prays that their presence may be dispensed with. The Criminal Petition is accordingly dismissed. The Court below is directed not to insist for the presence of the petitioners/A4 & A5 for each and every adjournment, unless it feels that their physical presence is necessary for any specific purpose.
Pending miscellaneous applications, if any, shall stand closed in consequence.
