THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION NO.22312 OF 2012 O R D E R :

This writ petition is filed for a writ of mandamus declaring the action of the respondents in proceeding to dis-engage the petitioners for the pupose of engaging outsiders/new persons for the operation and maintenance works in Kothagudem Thermal Power Station VI stage, Paloncha, Khammam District, as illegal and arbitrary.

This Court while admitting the writ petition granted interim direction on 12.10.2012, directing the respondents to consider the case of the petitioners and give preference to them in view of their previous experience.

Smt K.Udaysree, learned Standing counsel for the respondents submits that though the petitioners were issued proceedings dated 02.02.2013 asking them to submit individual representations furnishing the service particulars such as place and period of their engagement, wages paid by the contractors, details of agreement entered into with the contractor and nature of duties attended by them supported by the gate passes and EPF slips, the petitioners have not complied with the same. In view of the above submission, the respondents cannot be blamed for not consider the case of the petitioners. However, it is open for the petitioners to make individual representations as per the proceedings dated 02.02.2013.

With the above observation, the writ petition is dismissed. No order as to costs. As a sequel thereto, miscellaneous petitions, if any pending, in the writ petition, shall stand closed. ___________________________ A.RAJASHEKER REDDY, J 04.01.2017 dv
