THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.28897 of 2018 ORDER:

This writ petition is filed under Article 226 of the Constitution of India to declare the action of the respondents in opening and continuing the Rowdy Sheet No.3 opened on 29-11-2010 against the petitioner as illegal and arbitrary and consequently direct the respondents to close the Rowdy Sheet pending against the petitioner.

Heard learned counsel for the petitioner, learned Assistant Government Pleader for Home and perused the record.

It is stated by learned counsel for the petitioner that the petitioner was acquitted in all the criminal cases registered against the petitioner in the year 2013 and as of now no case is pending against him. The petitioner approached the 2nd respondent several times to close the rowdy sheet opened against him, but the respondents are not taking any action. Hence the present writ petition is filed.

This Court had an occasion to deal with the similar issue in W.P.No.38487 of 2017 dated 15-11-2017, relying on other judgments of this Court gave liberty to the petitioner therein to file explanation/representation within two weeks from the date

of said order and the competent authority was directed to examine the same and pass appropriate orders. Having regard to the facts and circumstances of the case and the submissions of learned counsel, this writ petition is also disposed of granting liberty to the petitioner to make a representation to the competent authority and on such representation, the competent authority is directed examine the said representation in the light of the law laid down by this court in W.P.No.4688 of 2012, which was disposed of on 16.03.2017 and in the judgments reported in SUNKARA SATYANARAYANA v. STATE OF ANDHRAPRADESH1 and B.SATYANARAYANA REDDY v.

STATE OF ANDHRA PRADESH2 and dispose of the same in accordance with law, within a period of two months from the date of receipt of a copy of this order.
