O R D E R:- This writ petition is filed to declare that the Tender Notice issued in NIT No. HMDA/DEV/HCIP/2016-17, dated 21.04.2016 so far as it relates to Item No.5 i.e. "Grant of License for Run, Operate and Maintenance of Children Inflatable and Giant Wheel in NTR Gardens, Hyderabad for 3 years', as illegal, arbitrary and violative of Article 19(1)(g) of the Constitution of India and set aside the same and further declare the action of the 2nd respondent in not considering the representation of the petitioner dated 28.04.2016, as also illegal and arbitrary and consequently direct the 2nd respondent to consider the request of the petitioner for extension of licence for further period of 3 years 6 months more in respect of Entertainment Project, Children Play Inflatable Activity at NTR Gardens, Hyderabad.

During hearing, the learned counsel for the petitioner has fairly requested this Court to direct the respondents to consider the representation dated 28.04.2016.

Metropolitan Development Authority appearing for respondent Nos.2 to 4 has reported no objection to consider the representation in accordance with law. In view of the above submissions, respondent No.2 - Commissioner, Hyderabad Metropolitan Development Authority is directed to consider the representation dated 28.04.2016 made by the petitioner and pass appropriate orders thereon in accordance with law, within a period of fifteen (15) days from today, communicate the same to the petitioner.

With the above direction, the writ petition is disposed of. No order as to costs.

As a sequel to the disposal of the writ petition, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
