The Hon'ble Sri Justice A.V.Sesha Sai Writ Petition No.11987 of 2017 Date: 06.04.2017 Order:

Heard Mrs.S.Nanda, learned Counsel for the petitioner, learned Government Pleader for Panchayat Raj (TS) appearing for respondent No.1, Mr.VV.Prabhakar Rao, learned Counsel for respondent Nos.4 to 7, and Mr.G.Narender Reddy, learned Counsel for respondent No. 8.

The only grievance of the petitioner in the present Writ Petition is non-disposal of OP.No.39 of 2014 on the file of the Election Tribunal -cum- Senior Civil Judge, Jagitial. The petitioner herein filed the aforesaid election OP under the provisions of Section 233 of the A.P.Panchayat Raj Act, 1994 read with Rule 12 (d) (iii) of the A.P.Panchayati Raj (Election Tribunals in respect of Gram Panchayats, Mandal Parishads, and Zilla Parishads) Rules, 1995.

According to the learned Counsel for the petitioner, no issues have been framed so far in the said election OP; that the term of the office of respondent No.2 is also coming to an end

AVSS, J W.P.No.11987 of 2017 Dt: 06.04.2017 within a period of 11⁄2 years; and that if the election OP is not disposed of within a timeframe, the very purpose of filing the same will be frustrated.

Having heard the learned Counsel for the parties, this Court is of the opinion that interests of justice would be served, if the Election Tribunal -cum- Court of the Senior Civil Judge, Jagitial, is directed to dispose of OP.No.39 of 2014 as expeditiously as possible preferably within a period of eight months from today.

Subject to the above direction, the Writ Petition is disposed of.

As a sequel to disposal of the Writ Petition, Miscellaneous Petitions, pending if any, stand disposed of as infructuous. _______________ (A.V.Sesha Sai, J) Dt: 6th April, 2017 lur
