THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO WRIT PETITION No.18047 OF 2017 ORDER:

This Writ Petition is filed, under Article 226 of the Constitution of India, for the following relief: "to issue a writ, order or direction more particularly one in the nature of a Writ of Mandamus declaring the action of the Respondents and their personnel without invoking the provisions of The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (Act 30 of 2013) in taking the private properties of the petitioner is illegal, arbitrary and violation of principles of natural justice further infraction of Articles 21, 300-A of Constitution of India and also Act 30 of 2013 and consequently direct the Respondents not to demolish or interfere the petitioner private properties bearing House Nos.7/677 to 687, H.No.7/689 to 694 and H.No.7/691 - 1 to 5 of Revenue Ward No.7, Block No.

1, Gandhi Nagar, Dharmavaram Municipality, Anantapuram District without following the provisions of The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (Act 30 of 2013) and to pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

From perusal of the written remarks received from the 3rd respondent and from the submissions made by the

learned Government Pleaders for Municipal Administration and R&B representing for the respondents respectively, this writ petition is disposed of, directing the respondents not to interfere with the possession and enjoyment of the petitioner without initiating the proceedings under the Act 30 of 2013. 3.

Accordingly and with the above direction, this writ petition is disposed of. Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. No order as to costs.
