THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CIVIL REVISION PETITION NO.146 of 2015 ORDER:

After having heard the learned counsel for petitioner and on perusal of the impugned Order dated 06.12.2014 in I.A.No.1139 of 2014 in O.S.No.311 of 2008 in the Court of Principal Senior Civil Judge, Srikakulam, the Civil Revision Petition is disposed of, at the admission stage, with the following Order :

Pursuant to the impugned order in I.A.No.1139 of 2014 in O.S.No.311 of 2008, the trial Court is directed to commence the trial within two weeks from the date of receipt of this Order and during trial take up the additional issue dated 04.08.2014 that "whether the Will dated 18.12.2009 said to be executed by the deceased/plaintiff No.1 in favour of second plaintiff is true and correct?" as preliminary issue and take up the evidence of all concerned parties and decide the said issue on merits treating the same as preliminary issue. As a sequel, miscellaneous petitions, if any, pending shall stand closed.
