THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.30821 OF 2012 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking to issue a writ of Mandamus to declare the Endorsement in L.Dis.B.A.No.786/2012/G1, dated 06.08.2012, through which the application submitted by petitioner No.2 for grant of building plan approval was rejected as illegal, arbitrary and contrary to the provisions of Hyderabad Municipal Corporation Act, 1956 and consequently, direct respondent No.1 to approve the building plan submitted by petitioner No.2 without insisting her to show 80" wide road.

When the matter is taken up for hearing, learned counsel for the petitioners informed that the petitioners are not pressing the writ petition and they want to withdraw the writ petition with liberty to file a fresh application before respondent No.1 for approval of the building plan of petitioner No.2 on the basis of some documents received by them.

Considering the submission of the learned counsel for the petitioners, this writ petition is dismissed as not pressed with liberty to the petitioners to file a fresh application before respondent No.1 for approval of the building plan of petitioner No.2. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
