HON'BLE SRI JUSTI CE A.RAMALI NGESWARA RAO Contempt Case No.1299 of 2017 Order:

This Contempt Case is filed alleging non-implementation of the order dated 01.07.2015 passed in W.P.No.19667 of 2015 while issuing notice before admission.

This Court passed the said order based on an earlier order passed in W.P.No.17070 of 2015 at the instance of the brother of the petitioner. The order passed in the present Writ Petition is as follows. "The Municipal Tax receipt filed by the petitioner for the period from 01.04.2015 to 31.03.2016 indicates his possession over the property bearing No.16-1-28/5A, Saidabad, Hyderabad. There shall, accordingly, be a direction to the respondent authorities not to interfere with his possession and enjoyment over the same except in accordance with the due procedure laid down by law." Now, it is stated that after passing the above order, a notice was issued under Section 7 of the Land Encroachment Act and the same is challenged in separate proceedings. In view of the same, it cannot be said that the respondents are prevented from following due process of law.

The Contempt Case is, accordingly, closed giving liberty to the petitioner to agitate his rights in accordance with law. There shall be no order as to costs.

As a sequel thereto, the miscellaneous applications, if any, pending in this Contempt Case shall stand closed.
