HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CIVIL REVISION PETITION No.2421 of 2015 ORDER :

This Civil Revision Petition is filed by the Petitioners/Defendants under Article 227 of the Constitution of India to set aside the order dated 23.03.2015 in I.A. No.192 of 2014 in O.S. No.20 of 2014 on the file of I Additional District Judge, Kadapa.

2) Heard the learned counsel for the petitioners before admission and before issuing notice to the respondents/plaintiffs and perused the material on record. There are no grounds to admit the revision invoking Article 227 of the Constitution of India for no illegality or irregularity in the impugned order passed by the trial Court making absolute the attachment before Judgment interim order, so far as item No.1 of the attachment petition schedule. Needless to say that any remedy is left open to the petitioners/defendants to the suit to furnish any security either to the third party or even of the suit schedule property free of all encumbrances for acceptance and to raise attachment to assure to recover the suit debt in the event of its decree.

3) With the above observations, the petition is disposed of. As a sequel, miscellaneous petitions pending, if any, in this criminal petition shall stand closed.
