HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.13978 OF 2015 ORDER:

This criminal petition under section 438 of the Code of Criminal Procedure is filed by the petitioners-A.1 & A.2 seeking anticipatory bail in connection with Crime No.100 of 2015 pending on the file of Shankarampet Police Station, Medak District registered for the offence under Sections 420, 468, 471 r/w 34 IPC.

The allegation against the petitioners herein is that they have forged the signatures of revenue officials, created fake pattadar passbooks in respect of certain lands and basing on that, they have obtained bank loan from APGVB, Narsingi Branch. Heard the learned counsel for the petitioners and the learned Additional Public Prosecutor.

Most of the allegations in the complaint are against the first petitioner herein and considering the nature of the offence, this Court is not inclined to grant anticipatory bail to the first petitioner and the criminal petition is dismissed as against him. As far as second petitioner is concerned, he is aged about 22 years and is a student and hence, this Court is inclined to grant bail to the second petitioner herein.

Hence, the second petitioner-A.2 is directed to surrender before the Magistrate concerned on or before 02.02.2016 and on such surrender, he shall be enlarged on bail on his executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with one surety for the likesum to the satisfaction of the Magistrate concerned. Further he is directed to report before the Station House Officer concerned daily between 10.00 a.m. and 5.00 p.m. for a period of fifteen days.

Accordingly, the Criminal Petition is allowed in part.
