HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN Civil Revision Petition No.1496 of 2017 ORDER:

The Revision arises out of the stay granted by the First Appellate Court in respect of a decree of possession.

2. Heard Mr. Y. Ramatirtha, learned counsel for the petitioner.

3. In a regular appeal under Section 96 of the Code of Civil Procedure, arising out of a decree for possession, the normal rule is that the First Appellate Court is to grant stay of the decree of possession. This is what the First Appellate Court has done. Therefore, I find no reason to interfere with the said order.

4. It is seen from the last paragraph of the impugned order that the First Appellate Court has posted the appeal for final arguments to today. Therefore, the revision is disposed of with a mere direction to the First Appellate Court to dispose of the appeal within a period of three (3) weeks from the date of receipt of a copy of the order.

As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
