This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure (for short "Cr.P.C") seeking regular bail to the petitioner who is arrayed as Accused No.2 in Crime Nos.615 of 2022 on the file of Station House Officer, Ramachandrapuram Police Station, Cyberabad registered for the offence punishable under Section 8 (c), read with 21 (b), 29 NDPS Act-1985. 2.
Heard learned counsel for the petitioner/Accused No.2 and learned Additional Public Prosecutor for the respondent-State. Perused the record.

The petitioner was arrested by the Ramachandrapuram Police for the reasons of being in possession of 13 grams of Cocaine. The concerned police having followed the procedure under the NDPS Act, the Cocaine seized was sent to the F.S.L. The investigation of the case is under progress. However, keeping in view that there are no other criminal cases pending against the petitioner and for the reason of the contraband seized being less than commercial quantity, the prayer for regular bail can be considered on conditions.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused No. 2 is granted bail subject to the following conditions:
i) The petitioner/Accused No.2 is directed to be released on bail on his executing personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties each for a like sum, to the satisfaction of Special Judicial Magistrate of First Class Prohibition and Excise Offences Court at Sanga Reddy.
ii) After release on bail, the petitioner/Accused No.2 shall appear before the concerned police station on every Monday for a period of four weeks.
iii) The petitioner/Accused No.2 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. Miscellaneous applications, pending if any, shall stand closed. _____________ K.SURENDER, J Date: 15.11.2022 PKR
