THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.2383 OF 2008 ORDER:

This writ petition was filed challenging the proceedings dated 16.01.2008 passed in favour of the third respondent pursuant to the order passed by this Court in W.P.No.3129 of 2007, dated 23.10.2007. Now the learned Government Pleader submits that pursuant to the said order, the third respondent has been continuing since 18.01.2008 in the said post. This Court, by order, dated 23.10.2007, directed the respondents 1 and 2 to enquire into nativity of the petitioner and the third respondent and pass appropriate orders on merits, if necessary, by giving them personal hearing. Though the learned counsel for the petitioner submits that no personal hearing was given to the petitioner, since the impugned order was passed pursuant to the orders of this Court and the third respondent is continuing for the last nine years, this Court is not inclined to interfere with the said order.

The writ petition is accordingly dismissed. Consequently, miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
