THE HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN CIVIL RIVISION PETITION NO.5127 of 2016 ORDER:

This revision petition arises out of the refusal of the Court below to reopen and recall.

Heard Mr. Narasimha Rao Gudiseva, learned counsel for the petitioner.

The petitioner already filed one application to reopen and recall and it was dismissed by the trial Court. Now it is a fresh application. Moreover, the suit was one for permanent injunction and it is up to the plaintiff to prove his possession. The plaintiff need not adduce evidence to show who are all occupying the properties in different boundaries. Therefore, the dismissal of the application is perfectly in order. Hence the civil revision petition is dismissed. There shall be no order as to costs.

As a sequel, pending miscellaneous petitions if any, shall stand closed.
