HON'BLE SRI JUSTICE S.V. BHATT CIVIL REVISION PETITION No. 2570 OF 2016 ORDER:

Heard counsel for petitioners and respondents. The revision is directed against the order, dated 12.04.2016, in I.A.No.383 of 2014 in O.S.No.32 of 2013.

The revision petitioners filed the instant application under Order 6 Rule 17 for amendment of the plaint to include the reliefs of declaration of title, mandatory injunction and perpetual injunction. Through the order impugned in the revision, the learned trial Judge dismissed the application.

With the assistance of the learned counsel appearing for the parties, I have perused the order impugned in the revision and the affidavit filed along with the instant application. Having regard to what is stated in the application and the conclusions recorded by the trial Court, prima facie, I am of the view that no exception to the findings recorded can be taken or pointed out.

The revision fails and accordingly dismissed. It is made clear that if the revision petitioners intend to work out these reliefs comprehensively, such course is left open for consideration in accordance with law. No order as to costs.
