THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.9724 OF 2022 ORDER:

This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 seeking bail to the petitioner who is arrayed as Accused No.1 in the event of his arrest in Crime No.214 of 2022 on the file of Station House Officer, Siddipet Rural Police Station, Siddipet District, registered for the offence punishable under Section 306 of Indian Penal Code.

Heard learned counsel for petitioner/Accused No.1 and learned Additional Public Prosecutor for respondent-State. Perused the record.

The petitioner is the wife of the deceased. According to the complaint, the deceased was constantly harassed by this petitioner on petty issues in their marital life. In the complaint in fact it is alleged by the father of the deceased that this petitioner was suffering from ill-health and mentally also, she used to threaten the deceased on petty issues.

In the suicide note and also the complaint lodged by the father of the deceased, it is apparent that there were constant fights in the family and issues which arise on a day to day basis in households. However, keeping in view that even according to the petitioner's father-in-law this petitioner was not keeping good health, her prayer for anticipatory bail can be considered. 5.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused No.1 shall be enlarged on bail in the event of her arrest subject to the following conditions:

i) The petitioner/Accused No.1 is directed to surrender before the Station House Officer, Siddipet Rural Police Station, Siddipet District within ten (10) days from today, and on such surrender, she shall be enlarged on bail on her executing personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties for a like sum each, to its satisfaction.

ii) On such release, the petitioner/Accused No.1 shall appear before the investigating authorities as and when required for the purpose of investigation.

iii) The petitioner/Accused No.1 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C. Miscellaneous applications, if any, pending shall stand closed. _____________ K.SURENDER, J Date: 11.11.2022 ns
