THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION Nos.11946 OF 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioner/Accused No.12 seeking bail in the event of his arrest in connection with Crime No.103 of 2021 on the file of Ichoda Police Station, Adilabad, registered for the offences under Sections 314, 148, 302, 307, 120-B, 448, 427 r/w.149 of IPC.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

This petitioner along with 14 others was investigated and charge sheet was filed by the Police. However, this petitioner was shown as absconding in the charge sheet. 4.

Learned counsel for the petitioner submits that petitioner was in fact in the city and he never absconded. 5.

Keeping in view that investigation is complete and charge sheet is already filed, in the interest of trial, the relief of anticipatory bail can be considered, subject to following conditions:-

1) The petitioner/Accused No.12 is directed to surrender before the Station House Officer, Ichoda Police Station, Adilabad, on or before 14.12.2023. Upon such surrender, the said Station House Officer shall release the petitioner/Accused No.12 on bail, on his executing personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties, for a like sum each to his satisfaction.

2) On such release, the petitioner/Accused No.12 shall appear before the concerned Court on every date of hearing.

3) The petitioner/accused No.12 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
